The Annual MLK Jr. Holiday Potluck Party and Canned Food Drive, scheduled for Saturday, January 14th at 7:00 pm, has become one of the primary fixtures of the New Democrats for Plainfield's community service initiatives; it is also a "must attend" event for Plainfielders interested in helping those who are unable to help themselves. Each year, the New Democrats Community Service Team selects a local Plainfield food bank to donate non-perishable foods to. This year’s donations will be given to the Shiloh Baptist Church Food Pantry on West 4th Street. This annual coming together of friends and caring individuals will be hosted again this year by my wife, Amelia, and me, at our home, located at 535 West 8th Street.

It is with a sense of community that Amelia and I gladly open our home so that the entire Plainfield community can come together as one, to commemorate the life and legacy of Dr. Martin Luther King, Jr.

In addition to a delicious variety of potluck food dishes, we will once again have wonderful live jazz guitar music during the evening, provided by Plainfield's own Joe Bonini. We will also have an informal kick-off of Obama '12, so feel free to wear your Obama gear!

Those who are able to donate are asked to drop off canned goods and other non-perishable food items on our front porch, any day of the week, beginning today, and continuing every day up to Saturday, January 14th. Those of you attending the party can bring your donations with you.

Council President's Remarks: An Agenda for 2012

First, let me begin by thanking my colleagues for the trust and confidence they have placed in me by choosing to elect me as their leader for the 2012 council year. Also, let me extend to all of you here, and to all of the residents of Plainfield, a happy, healthy and prosperous New Year.

We want, very much, to work cooperatively and collaboratively with the Mayor and her administration to improve the quality of life for all citizen, through enhancements to our public safety across all neighborhoods, proper enforcement of our property maintenance codes, and major improvements to our decaying network of roads.

We also intend to pursue greater partnerships with our other governmental entities such as the BOE, the PHA and the PMUA by way of meaningful shared services agreements. We are asking the Mayor to work with the Council to create shared service arrangements that will advance the goals of City Hall, the Board of Education and other governmental entities.

The Council stands with you to make this happen. To that end we propose the establishment of a Shared Services Committee with representation from the council, the administration, Board of Education, the PMUA, the Plainfield Housing Authority and the Plainfield Public Library. The purpose of this committee would be to identify opportunities for shared services and to make recommendations on how to best leverage resources to reduce cost and improve services.

Also, I have asked the Clerk’s office to reach out to the BOE to arrange a joint meeting between the BOE and the governing body, the agenda will be determined jointly by the two bodies.

Our Senior Citizens have been on the frontline of every battle of every kind that has been fought on every front; they have paid their dues. Colleagues, I ask you to join me in the creation of the Council’s Senior of the Year Recognition Award, an award that will go to one of our seniors for his or her service and dedication to our city and our nation.

Council members: we have an opportunity to appoint a commissioner to the Plainfield Housing Authority this year. Let’s make sure this person brings something positive to the table and is supportive of the redevelopment of Elmwood Gardens; a person that understands the role of a commissioner and who does not seek to cross the boundary that should exist between the commission and employees.

Let's work closely with the Union County One Stop Career Center; let’s create a jobs friendly ordinance aimed at creating employment opportunities for Plainfielders. Every redevelopment project and project funded with government money should go to the One Stop Career Center located in the Park Madison Complex to find Plainfielders who need jobs. Development has begun in our downtown; therefore, the time is right for us to pass an ordinance, in 2012, that makes job creation a reality.

Council members: let's press the Mayor and her administration to take more aggressive actions on bars that serve liquor to patrons that break the law and disturb the peace. We serve as the Alcoholic Beverage Control board and we must insist that police and code enforcement do whatever is necessary to clean up these establishments or put them out of business. We cannot afford to continually send our police officers to break up bar fights; they have more important work to do protecting our residents and making our neighborhoods safe places to live and work.

There have been many discussions during the past year about ownership of the 4.7 miles of highway known as Rt 28 that runs through our city. An agreement that dates back to 1927 placed responsibility for the upkeep of Rt 28 on the backs of Plainfield’s tax payers; it is an agreement that is now beyond our ability to bear. Hence, one of our goals for 2012 is to work with our 22nd district representatives to have legislation introduced that would seek to return Rt 28 to its rightful owner, the State of NJ.

As elected officials, we must be willing to be a part of the shared sacrifices that we are asking of our citizens and tax payers. To this end, the 2012 council will introduce legislation to end health benefits for all elected officials. Additionally, I will propose a Lame Duck Ordinance that will preclude lame duck legislators from attending seminars and conferences at the city's expense.

During the first one hundred days of this year we intend to adopt a capital ordinance that will result in the rebuilding of several of our roads; we will also encourage the administration to use our in-house equipment to preserve the life of our roads through the use of tarring and sealing techniques, and we will provide the financial resources to do so.

Transparency is something that we strongly believe in, that is why our council meetings can be seen on television. We want to expand this service by taping the meetings of the PMUA for broadcast on our cable channels. Additionally, we will work on creating a program that will give each member of the council an opportunity to address the community via 30-minute recorded interviews.

Let me say this: there is no partnership with the Council more important than the one between Mayor and Council. In 2011 the Council saw fit to increase its oversight on the Mayor and her administration. Whether this continues, increases or decreases depends on the level of transparency, mutual trust and respect. Let's all be honest, there is a huge need for improvement, and there are no easy fixes. I call for an improvement process that will lead to a revised schedule for the timely submission of resolutions for the council’s agenda and for an agreement which will result in directors and senior managers meeting with the various council committees. Today I am extending an invitation to the Mayor to meet with the Finance and Administration Committee to work out an agreement.

The people of Plainfield deserve a 2012 that is better than 2011. Therefore, let’s get to work forging meaningful partnerships, improving on our constituent services, delivering on our promises and delivering results. Again, happy New Year, and may God bless each and every one of you.

Thanks to my Colleagues for Their Vote of Confidence

Earlier this evening I was elected president of the Plainfield City Council; my name was moved in nomination by Councilor William Reid and seconded by Councilor Rebecca Williams. I received the unanimous support of my colleagues. I wish to take this opportunity to thank all of them for the trust and confidence they have placed in me in choosing me as their leader for the 2012 council year. I last led the council in 2004; I am grateful for the opportunity to serve in this role again. With the ongoing support of my colleagues I intend to shepherd some much needed reform, during this legislative session, building on the reform agenda led by former council president Annie Mcwilliams, over the past two years.

Much work lies ahead for us in the coming months; I intend to lead a united council in accomplishing the goals that were outlined during last evening’s re-organization meeting. We must work together in order to harness the untapped synergies of the seven for the common good of, one, Plainfield. I encourage each one of us to get out into the community and make service to our constituents more than just a mantra; let it be our reality as elected officials.

Netherwood Station Will Remain Open!

I got word a little while ago that the “discontinuance study” for Netherwood Station which was scheduled for today was cancelled. According to Allen Tanko, The U.S.P.S. District Discontinuance Coordinator, the Postal Service will be keeping Netherwood Station open. The notice I received simply read, “The USPS has decided to stop the study at this point and keep the Netherwood Station open.” No reason was given, and the vagueness of the phrase “at this point” means that another, future conversation may take place. For now, though, it looks like Plainfielders will still be able to use the Netherwood Station.

Service is Not What We Get, It's What We Give!

Dinner is served!

This past Sunday, the members of the New Democrats for Plainfield had dinner with the men, women, and children who reside at the Plainfield YMCA. This was done as one of our community outreach projects and in fulfillment of our mission to serve our community, including those less fortunate than ourselves. It is at this time of the year, in the spirit of the holiday season that we must give to those who need some assistance. Several members of our club did precisely that on Sunday, not just dropping off the meals, but serving and eating with our YMCA friends in need. It was a wonderful way to help lift the spirits of all present and share in a delicious homemade meal—smoked string beans, ham, baked chicken, macaroni and cheese, sweet potatoes, collard greens, barbecue chicken, peas and rice, baked ziti, corn bread, salad, and a variety of sumptuous desserts—all prepared by New Dems club members.

Dee and Niajah, with homemade gift bags for everyone!

Little 8 year-old Niajah Lawton, niece of Dee Dameron, added a special touch to our evening spent with the families by preparing (with a little help from Dee and her sister) 100 gift bags for the residents—these were Niajah’s gifts to them. It was a great lesson for an 8 year-old to learn and to teach. At a time when most children are looking for presents from Santa, Niajah was giving all that she could. As the Bible says, it’s more blessed to give than to receive.

We hope that the families with whom we had dinner on Sunday enjoyed the meal as much as we enjoyed serving it. Our only regret is that we couldn’t feed more people and that so many people still go hungry in this, the land of plenty. We will make sure that we do our part again with our next food drive in January.

In the Spirit of the Holiday Season!

The holiday time of year is one that we all look forward to; it’s a time to share with family and friends in the spirit of the season. It is also a time to remember the least among us and to do all that we can to make their holidays as pleasant as can be, given the current harsh economic realities. Joblessness, homelessness, and for some, hopelessness, are ingredients that could result in unexpected and out-of-character behavior.

As our brother’s/sister’s keepers, we must do all that we can to minimize the burdens, frustrations, depression, anxiety, and loneliness that so many may feel at this time of the year. To this end, if you can place joy into the heart of another person, do it; if you can lift the spirits of a neighbor who maybe in the doldrums, lift them; if you can shine light unto a path that will cause those who may feel lost to find their way, then let your light shine brightly; if you can provide warmth to a family that may be without heat this winter season, do so; if you can give from the many blessings that have been bestowed upon you, be a generous giver, and if you can ease the pangs of the hungry with a meal, be a provider; but in everything that you do, let it be from the heart.

Also, you must take care of yourself during this season, as there are those who do not have the community’s best interest at heart. As you go about your business, always be aware of your surroundings and take extra precautions when traveling alone to and from your vehicle with the many bags that some of you will be carrying. Also, be very careful as you travel the highways and through our city and be mindful of the speed limits. Be the eyes and ears of your neighbor and be on the lookout for anyone who might try to separate you and your neighbor from some of the things you own. Do not hesitate to report suspicious behavior, individuals and activity to our local Police Department.

Finally, have a good time; have fun this holiday season and do a good deed for someone—anyone, in the spirit of the season. God bless you and your family.

Report from the New Jersey League of Municipalities Convention: Day 3 – November 17, 2011

One of the interesting seminars I attended at this year’s convention dealt with PILOTs (Payments In Lieu Of Taxes). State Comptroller Matthew Boxer suggested very strongly that a municipality should conduct a very robust and comprehensive cost/benefit analysis up front before entering into a PILOT agreement with a developer.

Three very important questions should be addressed during the analysis:

1) is the PILOT necessary to attract development or would development still occur without it?

2) Is the type of development being proposed really needed?

3) Is it likely to achieve its intended economic goal?

Municipalities should guard against developers who may over-promise in order to make a project appear to be more attractive than it really is. If a PILOT is granted, the developer should be monitored and held accountable for the promised deliverables.

Another seminar I attended dealt with how to prevent sexual harassment and other hostile behaviors in the work place; it was presented by Esther H. Nevarez, Community Relations Coordinator in the Office of the Director for the New Jersey Department of Law & Public Safety. This was by far the most interesting of the eleven seminars I attended. The many definitions of sexual harassment were touched upon, along with the consequences and the remedies. We were reminded that women can sexually harass men; men can sexually harass women; men can sexually harass other men and women can sexually harass other women. Always keep in mind that being sexually harassed by a man or a woman is against the law.

The Department of Law & Public Safety, through the Division on Civil Rights, is responsible for enforcing the Law Against Discrimination (LAD). Anyone who believes that s/he has been a victim of unlawful discrimination should get in touch with the Division on Civil Rights at the office closest to where s/he lives or where the discrimination occurred.

Remember that it is against the law for anyone to retaliate against you because you choose to exercise your rights under the New Jersey Law Against Discrimination. I hope that this and other information brought to you over the past three days from the 2011 New Jersey League of Municipalities Convention has been helpful in some way.

Report from the New Jersey League of Municipalities Convention - Day Two: November 16,2011

Assembly Bill 4124 prohibits the distribution of campaign materials at any facility owned, maintained, operated, or leased by a local government. This includes any campaign materials that advocate the nomination or election of a candidate or the defeat of any public question.

Assembly Bill 4034 now permits Freeholders and Municipal Clerks to solemnize marriage and civil union ceremonies.

Senate Bill 2862 - Emergency Information: This bill would require the Municipal Clerk to publish holiday and emergency information on the municipality's website or in the local newspaper.

Within 7 days following the annual reorganization meeting, the Municipal Clerk shall post on the city's website the following: 1) the days which the offices will be closed during the year; 2) days on which the collection of garbage and recycling collection will be suspended or postponed; 3) recommend emergency routes for inclement weather.

If the municipality does not have a dedicated website, the Municipal Clerk shall publish the information along with the schedule of meetings in the municipality's official newspaper.

Assembly Bill 3785 - Public Officials: This bill prohibits an elected public official, who was not reelected to office, from approving the promotion or increasing the compensation of any public officer or employee for whom that elected official is the appointing authority during the period from the date of election to the end of the elected official's term; except as may be provided in a collective negotiation agreement.

Report from the New Jersey League of Municipalities Convention - Day One: November 15, 2011

Assembly Bill 4166: This bill permits primary elections to be conducted by mail in a county where the governing body of the county adopts an ordinance or resolution for the process. The bill includes procedures for the County Clerk and County Board of Elections.

Senate Bill 2996: This bill would require certain documentation as proof of voter identity in order to vote. Essentially, a voter, whether voting in person or by mail, would have to show or submit a copy of a New Jersey Driver's license, or a New Jersey non-driver identification card or other document.

This new requirement would not apply to any voter by mail-in ballot under the federal "Uniformed and Oversees Citizens Absentee Voting Act" or under the "Voting Accessibility for the Elderly and Handicapped Act."

Congratulations to My Fellow Democrats

Voters in Plainfield and across the state rejected Republican ideas and Republican values in favor of Democrats who have demonstrated their affinity for the poor and working class people of the state. Voters also sent a message to the governor, expressing their displeasure with his assault on organized labor. The people of Plainfield and the state of New Jersey prefer to hold on to their hopes, dreams and aspirations for a better quality of life, knowing that the remedy can only be prescribed by Democrats who readily acknowledge the ills of our society and are best able to administer a cure.

Republicans, in general, still believe in the notion that ours is a nation built by self-made men and women whose success was achieved solely on the strength of their own initiatives. The social responsibility of government for those who need a helping hand to gain a footing up from the gutters of despair onto a social and economic ladder that would take them to a loftier life altering and fulfilling experience is one that Republicans continue to reject in favor of a permanent underclass.

This stark philosophical difference between Democrats and Republicans is the reason the playing fields of society continue to be laden with hurdles that are "tripping hazards" for America’s poor and middle class. It is partly the basis for the battle that is being waged between the 99% and the 1%; it is the reason why Democrats in general feel the need to come together in opposition to the rigid ways of the Republican party; it is the reason why Plainfield Democrats stood in solidarity with supporters of the trade union movement and in strong opposition to those who, if given the opportunity, would align themselves with a governor who is hell-bent on turning back the clock on organized labor.

Plainfield Democrats and all progressive-minded people must begin to organize in a show of support for President Barack Obama. The focus must now shift to 2012, a year in which much will be at stake, as Republicans are expected to continue digging in their heels to bring government to a halt as they pursue their obstructionist agenda for the purpose of defeating the President. We must push back and we must blunt the force of the Republican attack.

I congratulate all Democrats on their victory at the polls on Tuesday, and I encourage all to mobilize forces to do all that we can and all that we must to ensure victory for President Obama and other Democrats in 2012. Our work must begin today if there is to be success tomorrow. Again, congratulations to my fellow Democrats.

A Vote for Democrats This Year is a Vote for President Obama Next Year

This Tuesday, the entire state legislature is up for grabs, and Republicans are chomping at the bit to take control and to join Governor Christie in his march to the extreme right with his single-minded focus of bashing the labor movement--a movement that is responsible for the breadbaskets from which working families have been eating for generations and for the economic engines that have moved them up from poverty to a life of prosperity--into submission. I call on democratic and independent/non-affiliated voters in Plainfield to join me on Tuesday in voting for all of the Democrats in column A.

This is not an election year to stay at home; we must use it to elect Democrats so as to build momentum as we go into 2012, when we will all need to support the reelection of President Obama. A vote for Democrats is a vote for the millionaires tax; it’s a vote for the demonstrators on Wall Street who are fighting for the 99%; it's a vote for upholding collective bargaining agreements; it’s a vote for rebuilding America’s infrastructure and for job creation; it’s a vote for New Jersey’s teachers and for teachers all across the country; it’s a vote for protecting Medicare and Social Security; it’s a vote for working families and for those in the middle who have been squeezed to the point of seeing their American dream turned into a nightmare; and it’s a vote against those who are tearing down our President.

Vote for Democrats in column A. Let’s build momentum and let’s carry it into next year. This Tuesday’s election is really about the reelection of President Obama; it’s a dry run to test your willingness and eagerness to come out in large numbers, as you did three years ago. A vote for democrats this year is a vote for President Obama next year. Don’t give the media any reason to spin the voter turnout from this Tuesday into voter suppression next year. Come out and vote.

Call Me - I Make House Calls

Oftentimes, the position of an elected official cannot be fully grasped from the written word or from the commentary you see on television during the airing of council meetings. This is why I have always enjoyed speaking to individuals on a one-on-one basis or in a group setting, such as a block or neighborhood association meeting. This preference, on my part, is one that brings me closer to the residents I represent and provides an opportunity for individuals to get to know where I stand on the issues that are important to the city of Plainfield, to them, and to me.

Hence, I would welcome the opportunity to have a conversation with any of you, so that we can truly communicate, in the comfort of your home or that of your neighbor.

Hurricane Irene: Notice to constituents based on my conversation with Plainfield's Public Safety Director

UPDATE: Designated shelters are Washington Community School (427 Darrow Ave), Emerson Community School (305 Emerson Ave), and the Plainfield Senior Citizens Center (400 E. Front St).

The City is prepared for Irene.

Police HQ will be used as the command center.

Flyers have been prepared and will be distributed to low-lying areas that maybe prone to flooding.

A six-wheel drive vehicle capable of climbing steps is available for use.

The Fire Department is ready with boats in the event of severe flooding where people have to be rescued.

DPW, Police, and Fire are available to assist residents and to respond to emergencies.

Meals were ordered in case people have to be placed into shelters.

The voluminous emergency plan document is up to date as it relates to Police and Fire; the portion dealing with shelters is awaiting approval from the State Police.

The city is preparing for the worst and has ordered plenty of supplies, including food that can easily be prepared.

Chain-saw crews will be on standby to clear city streets.

PSE&G has been contacted and will respond as quickly as possible.

City shelters will be identified by Friday and will be posted on the City of Plainfield website

This Fall, I Will Be Supporting Scutari, Green, and Stender for Reelection

The representatives of the 22nd legislative district have recently received the endorsement of the AFL-CIO. State Senator Nick Scutari, Assemblyman Jerry Green and Assemblywoman Linda Stender all possess a very good track record on the state level; Scutari is best known for his advocacy for quality education, public safety, and for the compassionate use of medical marijuana; Stender for her strong commitment to public safety, women’s health, and fair housing reform, while Green is best known for his passionate support of decent housing for all of New Jersey as chair of the Housing and Local Government Committee. Most recently, this trio stepped up to the plate in support of organized labor and in opposition to Governor Christie’s assault on health benefits for members of the labor movement. They stood tall with the labor movement while Republicans and some wayward Democrats, led by Senate President Sweeney, gave organized labor the proverbial finger. Senator Sweeney committed an act of treason against the very movement that has made him one of its leaders.

I believe that the state of municipal finances across all 566 municipalities requires concessions on the part of organized labor; I also believe that with ever-increasing property taxes, with a jobless rate that is over 9%, and with thousands of homeowners facing the prospect of foreclosure, there needs to be shared sacrifice on the part of all, organized labor included. However, I believe that the bargaining table is the place where needed reform can and should be achieved. The National Labor Relations Act of 1935 and other laws require employers to bargain with unions and to do so in good faith. We must not turn back the hands of time. Any and all attempts to crush the labor movement by way of legislation should be resisted and should be vehemently opposed by all progressive minded individuals and by all people of good will.

There can be no denying that many of us have benefited enormously from the labor movement, and owe much of our success to the early pioneers of the movement who had the temerity to confront unfair labor practices, harsh working conditions and exploitation. Much of what we enjoy today and take for granted, are the fruits of seeds that were sewn by people like A. Phillip Randolph, César Chávez, Samuel Gompers, John L. Lewis, Bayard Rustin, Lane Kirkland and Mary Harris Jones, to name just a few. I owe my career today to a shop steward who stood up for me when a manager wanted to preserve the job of his girl friend who had less seniority than me. I kept my job in the mail room at US Lines and the girlfriend of the boss had to go, thanks to organized labor.

I stand with elected officials who stand with organized labor, I may not always agree with them, but I will give credit where credit is due. Organized labor should not fall victim to the bully pulpit of a governor’s office, and should not be betrayed by politicians who lack an appreciation for the historic struggles that have brought us this far along the way. Governor Christie maybe willing to throw out the baby with the bath water, but if we allow that to happen, chances are the baby will die and organized labor as we know it will cease to exist. Let’s keep the baby alive, let’s support those who support organized labor.

To that end, I stand firmly with the democrats in the 22nd legislative district who stood tall with organized labor in an attempt to blunt the force of Christie’s attack. This fall I will be supporting Scutari, Green and Stender for reelection as a means of keeping the Governor in check.

Police Consolidation: A Shared Service Whose Time Has Arrived

On March 25th of this year, I submitted a proposal to Union County Prosecutor Ted Romanow that, if adopted will lead, in my view, to a radical transformation in the way crime is addressed in Union County from its eastern end at Elizabeth to its western end at Plainfield. An article in yesterday's Star-Ledger has prompted me to go public with my proposal, given the number of similarities to what I proposed and what officials in Somerset County are now reviewing. My proposal is highlighted below in blue:

“Hello Ted:

You may recall that a couple weeks ago, at the Gun Summit in Plainfield, I proposed the consolidation of all police departments in Union County under your leadership as Union County’s Chief Law Enforcement Officer. I was pleasantly surprised to open the Star Ledger yesterday to a story that talked about Governor Christie pitching the very same idea in Camden County, and that Joe DiVincenzo, Jr., Essex County Executive Director, and representatives from Mercer County were in attendance. I firmly believe that the time for shared service consolidation of all twenty-one police departments and the County Police under one law enforcement umbrella has arrived.

Hence, I believe it to be in the best interest of all twenty-one municipalities in Union County, for a plan to be put in place, or for what I would describe as a Blue Ribbon Panel to be assembled to begin a study that would, hopefully, lead to consolidation. The harsh economic realities of today require all leaders to think creatively and out of the box in order to find the most cost effective and efficient ways to deal with, not only our economic issues but our social issues as well, not least amongst them, drugs, gangs and guns. The gathering threat from an increase in violent crimes in the eastern and western ends of the County, and the rising tide of property taxes that threaten to overwhelm homeowners require bold action and leadership from all of us.

With that said, I am again stepping out on a limb to recommend consolidating all of the police departments in Union County, and creating regional precincts and sub precincts headed by Deputy Commissioners and senior Captains. All precincts would report to a County Police Commissioner who would in turn report to the County Prosecutor. What gains can be achieved from the consolidation of all twenty-two police departments, including the Union County police? I would suggest the following:

1. By appointing one Police Commissioner and four Deputy Commissioners to manage and direct countywide police operations, greater accountability and efficiency at a reduced cost can be achieved

2. The elimination of the rank of Police Chief/Director would result in significant cost savings

3. Reduction in the number of Police Captains and lieutenants would result in significant cost savings

4. The closing of all local police departments would reduce overhead costs

5. The establishment of four regional police precincts headed by Deputy Commissioners and sub-precincts, maybe four, headed by senior Police Captains would streamline operations and reduce costs over the long term

6. The creation of joint municipal courts or regional courts could be a bi-product of police consolidation

7. More effective police deployment and a greater police presence would be the end result

8. Heavier concentration of officer in hot spots to the eastern and western ends of the County would be a likely outcome

9. The replacement of the current 4 on 4 off work schedules with needs based work schedules would result in more officers being available on a daily basis

The above list represents some of the possible outcomes of consolidation, and is offered as a jumping off point for discussion. The need for a capital investment in new regional precincts or to expand existing facilities to create precincts will weigh heavily in the discussion. I am sure that there are a myriad of other issues that will have to be identified and addressed, hence the need for a Blue Ribbon Panel.

It is my hope, that my comment at the Gun Summit of a couple weeks ago, and this email, will be the spark that ignite a broader discussion about how best to provide police services to all of Union County more efficiently and more cost effectively. If these thoughts are already simmering in your mind, I encourage you to bring them to a boiling point.”

It is my hope that the above proposal that was sent to Prosecutor Romankow will spark a serious discussion by municipal officials, law enforcement personnel and citizens across Union County.

Let me close by acknowledging the excellent work done by our Plainfield Police Department in policing the streets of Plainfield with limited resources and manpower. The lack of sufficient resources and the right complement of officers, stemming from budgetary, disciplinary, legal, and other constraints affects our dedicated law enforcement personnel’s ability to deal as effectively as possible with crime in a way that would make all of our citizens feel safe on the streets and in their homes. The reality of crime and the accompanying perception of our city being a place to avoid are challenges that we must collectively work to overcome.

Hence, I am of the view that we must look beyond our borders for long term solutions that will allow for systemic remedies to Plainfield’s most pressing social ills: drugs, gangs, and guns. The consolidation of the twenty-two police departments, including the Union County Police, will result in lower cost to tax payers through greater economies of scale, enhanced neighborhood safety resulting from a greater police presence, better coordination of countywide crime fighting strategies, and the eventual elimination of disparities in police salaries. Police consolidation is a win for law enforcement and a win for the affected communities.

Police consolidation is a shared service whose time has arrived.

Plainfield’s Latest Victim of Gun Violence

It was with great sadness that I learnt of the tragic death of Eduardo Leaty in a senseless act of gun violence at the family store on East Sixth Street. Eduardo was the brother of City of Plainfield employee Marilyn Leaty-Nieves, and brother-in-law to one of Plainfield’s bravest, firefighter Samuel Nieves. This latest homicide is Plainfield’s 8th since January of this year and the 13th in the past 12 months.

The death of Mr. Leaty is a sad reminder of the terrible toll that gun violence and other criminal acts have taken in our city. No family should have to experience the loss of a loved one at the hands of another human being. We must, now more than ever, come together using the CGPS approach (see my blog post dated May 18, 2011) to address this problem if we are to save lives and save our city. Politics of division have no place in a city where a hurricane of volcanic proportion has been erupting to consume many innocent lives in its path. We must act cooperatively, collectively, and collaboratively to stem this ever rising tide of violence; if we do not, more Poppy Harlows (the CNN correspondent whose report contained much inaccurate information) will come knocking, and the city’s reputation will continue in a free fall.

Hence, a month or so ago, I provided Mayor Robinson-Briggs with templates on successful crime strategies used in Salinas and San Jose, cities that are comparable in size to Plainfield and that once experienced the level of gang and gun violence that Plainfield is experiencing today. The templates were provided by Pastor Dr. Lamont Thomas through his anti-gun violence initiative. I offered myself as a resource to work with the mayor on the formulation of strategies aimed at eliminating gangs, guns and violence from our city.

In the meantime, the tragic and violent death of Eduardo Leaty has left the family in great need of financial and other assistance. I am asking those of you who are able, to make a financial contribution to help with the funeral arrangements; your contributions can be made to:

The Creator Will Smile on Me

I just got word, a short while ago, that information regarding a debt that I owe to a credit card company has been distributed on cars throughout the City of Plainfield. I was served with papers on Thursday by a local police officer who works through the Sheriff’s office. The papers pertain to a lawsuit that was filed on behalf of the credit card company that seeks to recover the $46,000 that I owe. The papers that were served on me give me 35 days to respond; failure to respond could result in a judgment against me for the debt owed. Those are the facts.

As most of you know, I have been unemployed for almost two years, and like many of you I have been feeling the pain of the very harsh economy that has seen an unemployment rate hovering close to 10%. I am not immune to financial hardships; I am like all of the other people whose financial lives have been turned upside down due to their unemployment status and other special situations. Unlike most of the unemployed, I am also the victim of a very hostile political climate; one that has brought me to my knees and has rendered me BROKE. Over the past two years I have exhausted all of my financial resources, yet through the grace of God I have been able to make ends meet.

With that said, the attempt by those in law enforcement and politics to embarrass me has not and will not succeed. I am not ashamed of my current financial reality, and will not allow my financial reality to prevent me from reaching my goal of transforming Plainfield’s political landscape. Those who will attempt to use my unearned financial hardship, which was borne of political hatred and venom, will be very disappointed. I remain undaunted, undeterred, unbroken, unbowed, and unbent.

The behavior of those who seek to gain from my financial crisis and misfortune will be called into question, weighed in the balance, and found wanting. Those responsible for the dissemination of court papers served on me just this past Thursday will be investigated and held accountable.

I know beyond any doubt that my wife Amelia and our daughters love me, the Creator loves me, and the scores of friends that I have do love me, and so do the people of Plainfield who elected me as one of their trusted servants. This is what keeps me strong, this is what keeps me going and fighting for Plainfield. This is why I am asking all who read this post to let the rest of Plainfield know that we must reject this cruel act and those who are behind it.

On Tuesday June 7^th, vote for Honest, Ethical Leadership for Plainfield, vote for all of the candidates in Column C.

I know, beyond any doubt, that the Creator will smile on me and I will repay every debt that I owe.

The Community, Government, Parents, and Schools (C.G.P.S.) Must Work Cooperatively, Collectively, and Collaboratively to Fight Crime Epidemic

When violence plagues a community, the average citizen looks to government as the panacea that would eliminate it from amongst its midst, but nothing can be further from the truth. If a community is to be truly safe, it must police itself; citizens have to get involved and must be the eyes and ears of law enforcement. Passive community involvement breeds apathy, whereas active community involvement leads to safer neighborhoods. We, the residents of Plainfield, must be more civic-minded and must demonstrate a willingness to be more involved, to the point where our vigilance keeps the criminals on their toes, constantly moving until they discover the path that leads away from our neighborhoods or away from a life of crime. We must not allow the new criminal enterprise to view our community as a safe haven for their sordid behavior, and we must become friendly with the cops and allow them to use our homes as staging areas for some of their intelligence gathering. A community that polices itself will, ultimately, be a safer community.

Another part of the solution to the epidemic of crime that is plaguing Plainfield is an intergovernmental partnership; one that brings together the resources of the city, the county, the state of New Jersey, and the federal government. The high level of competence of the local Plainfield Police Department is no match for a criminal enterprise that has amassed an arsenal of weapons and a level of sophistication that are the envy of a four-star general on the frontlines of a battlefield. What Plainfield needs in order to effectively counter this level of violence is a surge in troops from other law enforcement agencies that will complement the local PD so as to overwhelm and overpower, with force and good crime fighting strategies, an army of social deviants that is wreaking havoc locally and sullying the city's reputation across the Tri-state area. Our law enforcement agencies need to identify and use some of the proven methods to break the code of silence that exists amongst gangs; extraordinary challenges require extraordinary solutions. The time for an elaborate intergovernmental law enforcement approach without regard for borders has arrived, and we must embrace it as a part of the solution to our crime epidemic.

However, any solution to our current crime epidemic must involve our very first line of defense; it’s the parents of our young people. Too often the vicious cycle of poverty, the tender age of parents who are slightly older than their kids, and the many broken homes with no fathers are major ingredients in an intoxicating mix that leads to wayward and out of control youths who use the gang life style as a symbol of power and, for far too many, as a symbol of love. We need parents to be more involved in the lives of their children and, yes, we need fathers to be the men they need to be. Fathers must be role models to their children and must also be those whom their children turn to for love and advice. A child should never feel that s/he can get more love from in the streets than in the home. I grew up without a father in my life, but I had a support system and an extended family that helped to guide me through my adolescence right into my young adult years. Our young people need a support system that will help to break the stranglehold of poverty that keeps them mired in a life of crime; they need extended families that are empowered to discipline, and loving and caring parents who can be parents and not be in need of parenting.

Having said all of the above, the schools have a significant role to play in the fight to save our young people. Most of the young people in our city are in our schools each and every day for most months of the year. Our schools must teach more than just the three “R's”; they must also contribute, in a very structured way, to the development of character and social consciousness that leads to radical social transformation. But this is not a job for only the teachers and administrators; it is the responsibility of all of us. We must go into the schools and be mentors, career counselors, entrepreneurial advisors, and coaches. And most important of all, our schools must build a solid academic foundation and provide the students with the tools they need to construct a life of which all Plainfielders can be proud.

I firmly believe that we can tackle our crime epidemic with a high degree of success if we follow the CGPS model that I outlined above. That is, the community, government, parents and schools must work cooperatively, collectively, and collaboratively to fight the crime epidemic and to apply a tourniquet to a gaping wound in order to stop the bleeding.

North Avenue Road Project Should Not Be Used Play "Politics"

This is campaign season in Plainfield, and the red herring (known as the North Avenue pipes) is beginning to dart across the trail so as to create a diversion from the real issues and financial challenges facing the City. These are issues such as:

unauthorized expenditures;
the squandering of $460,000 federal dollars on the partial sheet rocking of the Tepper's basement;
the waste of city funds and grant dollars on the construction of a bathroom that is a little bigger than a 6’ x 12’ shed at a cost of over $220,000 in Bryant Park on East 6^th Street;
the complete breakdown of controls in the purchasing division;
the refusal of the mayor to allow the CFO to meet with the Finance and Administration Committee;
the refusal by the Mayor to allow any department head to attend the Council’s ward meetings; the doling out of city funds to non-profit organizations in violations of Article VIII, 3,2 of the new State Constitution;
the refusal to put the budget documents online;
the failure to cooperate and to collaborate with the council on an early start to the budget process;
the failure to negotiate with the collective bargaining units, and the list goes on and on.

Meanwhile costs continue to escalate. These are some of the many issues the council has been wrestling with, and we have been making good faith efforts to meet with the Administration to address them. However, we have been stymied by a wall of frustration erected by the Mayor (now "acting" as the city administrator).

Now, back to the red herring known as the North Avenue pipes: sadly, one very important point being missed in the discussion about the North Avenue pipes is the tremendous benefits the residents on North Avenue as well as other residents in the surrounding neighborhoods have derived from that great project. The flooding that once plagued that neighborhood has all but disappeared as a result of that well thought-out and designed project. I am happy to have been one of the councilors who supported the McWilliams administration on that project. All elected officials who supported it have a great deal to be proud of, and I am sure that Mr. Muhammad who lives on North Avenue can attest to the benefits that he as a homeowner has derived.

If only the current Administration would get busy working with FEMA to redraw the flood maps, the residents of the First Ward would be able to get the financial relief they seek. They deserve to realize a drastic reduction in the flood insurance premiums they currently pay. As a matter of fact, many of the residents in the First Ward could make a very strong case for the elimination of flood insurance all together, all as a result of the North Avenue road reconstruction and flood remediation project, a project that was conceived in the minds of individuals who wanted nothing but the best for the residents of the First Ward. It is shameful that some would allow the trees to blind them, causing them to lose sight of the beauty that is the forest.

The North Avenue road reconstruction and flood remediation project should be seen for what it is: a success story that needs to be replicated, not one to be criticized for the purpose of scoring cheap political points.

My Proposal for the Calendar Year: An Idea Whose Time Has Come!

Two years ago, when I returned to the Plainfield City Council, I recommended to the Mayor and to my council colleagues that the City of Plainfield should revert from a fiscal year to a calendar year. At the time, I was told that the absence of a CFO would make it somewhat challenging for the administration to do the work that would be necessary to prepare the application to the Division of Local Government Services in the New Jersey Department of Community Affairs.

However, I never gave up on the goal of having the city revert to a calendar year. Out of the 51 municipalities that were previously on a fiscal year, roughly 26 have already reverted. When the 2011 goals of the Finance and Administration Committee were announced earlier this year, we knew that reversion had to be a priority. As the Chairman of the Finance and Administration Committee I laid out the steps that would be necessary in the process of reversion as well as the advantages to doing so.

As has been reported by the current CFO, the city faces a budget gap of $3.4 million. The gap has been expanded as a result of the Council’s decision to restore funds to two of the city’s operating divisions, and will expand even further when the city receives a bill from Union County for the county’s 5% share of all PILOT revenues paid to the city since 2005. Prior to 2005, all PILOT revenues went to the city, with none going to the county or to the local school district. However, due to a change in the law dating back to 2005, all counties must now receive 5% of PILOT revenues. Therefore, what was thought to be a $3.4 million budget gap could easily balloon to over $4 million, depending on the bill that has been or will be sent to the city from the county.

Hence, in light of the rising expenses, declining revenues, and a budget gap that continues to grow, the idea of reverting to a calendar year, which I first proposed in 2009, is one whose time has come. I am happy to report that the city now has a CFO who is savvy enough to be able to put all of the required pieces together to assists the council in making this idea a reality. The primary benefits of reverting from a fiscal year to a calendar year are as follows:

A fiscal year that runs with the calendar year from January to December would be aligned with the election cycle and would allow newly elected official to participate in the budget process from the outset. Newly elected official would no longer be able to say that they had nothing to do with the budget.
The confusion stemming from the use of two tax rates, one for the fiscal year and one for the calendar year, will disappear and property owners will be better able to understand their tax bill.
The city will be able to pull in all state aid into the transitional year budget between July 1 and December 31, thus regenerating surplus and regaining a more solid financial footing.
On January 1, the City would become eligible for a new round of state aid as a calendar year municipality.
The potential loss of jobs and services that could result from the challenge of complying with the governor’s mandated 2% CAP (when faced with a potential budget gap that could reach over $4 million) would be minimized.

Although what I have outlined above are key benefits of reverting from a fiscal year to a calendar year, I must caution that this is not a panacea; these financial benefits must be viewed as one-time hits. They do not eliminate the need for the city to be fiscally prudent and for the collective bargaining units to come to the table in good faith to work with the Mayor and Council to find long term solutions to the financial challenges the city faces. All parties must now work together to ease the property tax burden while, at the same time, preserving as many jobs as possible and maintaining quality municipal services.

You would recall that my wife Amelia and I hosted the New Democrats annual holiday party and canned food drive for the purpose of helping to address the problem of hunger in our city. This annual event is held in celebration of the life and legacy of the late Rev. Dr. Martin Luther King, Jr.

I am happy to report that we were able to collect over a ton of canned goods and other nonperishable food items. All items collected were recently turned over to the Starfish Food Pantry, right here in Plainfield.

A couple months ago, the Plainfield City Council adopted an ordinance creating a Board of Recreation Commissioners for the purpose of expanding recreational opportunities for our youth and senior citizens. On the tenth day after its final adoption, the ordinance creating the Commission was vetoed by the Mayor. This past Monday, an attempt to override her veto failed by a vote of 4 to 3; five votes were required.

Hence, those of us who supported the ordinance must now respect the outcome of Monday’s meeting and look for other ways to expand the City’s recreation programs. The beauty of our democracy is that the outcome of the vote is always respected, and people on both sides of the vote always find a way to move forward, in spite of their differences. Now is the time for us to do just that - move forward.

Given that the Commission was vetoed by the Mayor, and given the outcome of Monday’s meeting, it is important for us on the governing body to respond appropriately by providing the required level of funding necessary to ensure retention of the current full-time staff. The question is, how do we do that and remain in compliance with the applicable New Jersey state statute? The proposal that was advanced by the Mayor and her and Administration, in the form of resolutions R105, R106 and R107 was illegal under NJSA 40A:4-46 quoted below:

40A:4-46. Emergency appropriations
A local unit may make emergency appropriations, after the adoption of a budget, for a purpose which is not foreseen at the time of the adoption thereof, or for which adequate provision was not made therein. Such an appropriation shall be made to meet a pressing need for public expenditure to protect or promote the public health, safety, morals or welfare or to provide temporary housing or public assistance prior to the next succeeding fiscal year.

In light of the statute quoted above, I could not, in good conscience, knowingly support a funding request disguised as an emergency that was a clear violation of the law. It is for this reason that I could not and did not support any of the three resolutions referenced above.

However, I am willing to support a transfer resolution that would restore full funding to the Division of Recreation. Therefore, in the spirit of cooperation and collaboration, I will be suggesting to the Administration that it prepare a transfer resolution for adoption by the council in May, and I will encourage my colleagues to support such a transfer request. Everything will be done in compliance with the law, to provide for wholesome recreational opportunities for all in the City who need them. This is a pledge and a commitment.

As to the Purchasing Department, a different idea should be considered; that idea is called a Purchasing Shared Services Agreement. Although I know that purchasing is the responsibility of the CFO in all municipalities where a QPA has not been appointed by the governing body, I am still sensitive to the fact that the CFO is part time and may need more time to get his arms around the many challenging financial issues facing the City.

Therefore, I am proposing a shared service agreement between the City and the Board of Education that would buy the CFO some time, and allow for the Qualified Purchasing Agent from the BOE to be shared with the City. Shared services performed at a high level of efficiency and effectiveness, and with measurable benefits that flow to the bottom line must be pursued as part of the solution to the financial crisis we face in Plainfield. The 2% cap, the $4 million budget gap, and the need for property tax stabilization and relief are the sign posts by which we must be guided. It is to this end that I am proposing a Purchasing Shared Services Agreement for the mutual benefit of the City and the BOE.

I will be asking Council President McWilliams to place this on the agenda for discussion at our April meeting. Just like the CFO for a municipality is almost always the Treasurer of School Monies and is responsible for signing checks and reconciling the bank accounts for the BOE, for a stipend, there can be a similar arrangement with the QPA at the BOE to provide purchasing services to the City for an agreed upon amount that would result in major savings.

There should be no doubt, in anyone’s mind, about our commitment to doing what we believe to be in the City’s best interest, without fear or favor, and without malice. I, for one, will always strive to be guided by the dictates of my conscience; I will compromise when the situation warrants, and I will reverse course when a new direction is required.

Hence, I will support the restoration of funding, by way of a budget transfer in May, to the salary and wage line in the Recreation Division, and I will advocate for a Purchasing Shared Services Agreement with the BOE.

It is my hope, that in these very challenging times, reason will triumph over emotion, verbal hostility will give way to civil discourse, and that collaboration with results will be the fruit of our collective labor. We must all stop and take a deep breath, exhale the impurities affecting our thoughts, and breathe the fresh air of cooperation that is essential to our success.

Beware of Title 59

The very harsh winter of 2011 has created many hazardous conditions in Plainfield and in other municipalities across the state of New Jersey. Conditions that, if left unattended, could result in property damage that could leave unsuspecting or uninformed citizens holding the bag. Under Title 59 of the New Jersey Constitution, municipalities are granted immunity from liability if certain conditions are not met by a plaintiff, i.e., plaintiff must prove that a municipality had actual or constructive notice of the dangerous condition. Beware of Title 59; I am quoting sections of that statute for the benefit of all Plainfielders:

59:4-1. Definitions
As used in this chapter:

a. "Dangerous condition" means a condition of property that creates a substantial risk of injury when such property is used with due care in a manner in which it is reasonably foreseeable that it will be used.

b. "Protect against" includes repairing, remedying or correcting a dangerous condition, providing safeguards against a dangerous condition, or warning of a dangerous condition.

c. "Public property" means real or personal property owned or controlled by the public entity, but does not include easements, encroachments and other property that are located on the property of the public entity but are not owned or controlled by the public entity.

59:4-2. Liability generally
A public entity is liable for injury caused by a condition of its property if the plaintiff establishes that the property was in dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition, that the dangerous condition created a reasonably foreseeable risk of the kind of injury which was incurred, and that either:

a. a negligent or wrongful act or omission of an employee of the public entity within the scope of his employment created the dangerous condition; or

b. a public entity had actual or constructive notice of the dangerous condition under section 59:4-3 a sufficient time prior to the injury to have taken measures to protect against the dangerous condition.

Nothing in this section shall be construed to impose liability upon a public entity for a dangerous condition of its public property if the action the entity took to protect against the condition or the failure to take such action was not palpably unreasonable.

59:4-3. Actual notice; constructive notice
a. A public entity shall be deemed to have actual notice of a dangerous condition within the meaning of subsection b. of section 59:4-2 if it had actual knowledge of the existence of the condition and knew or should have known of its dangerous character.

b. A public entity shall be deemed to have constructive notice of a dangerous condition within the meaning of subsection b. of section 59:4-2 only if the plaintiff establishes that the condition had existed for such a period of time and was of such an obvious nature that the public entity, in the exercise of due care, should have discovered the condition and its dangerous character.

I encourage my constituents to inform the City of any hazardous condition in the public right of way, such as pot holes, that they are aware of. By so doing, you will be protecting your interest and that of others in the event of property damage arising from said hazardous conditions.

In the meantime, drive safely and avoid road hazards.

A Plainfield Citizen's Suggestions for Greater Efficiency and Effectiveness

I recently received an email from a Plainfield citizen with suggestions for greater efficiency and effectiveness in the way the City responds to snow emergencies--plowing and removal. I am posting that email here in its entirety.

On Wed, Dec 29, 2010 at 7:34 PM:

1. Mr. Mapp, this recent snowfall started me thinking of how we could respond better as a City to such a hazardous condition and with the most efficiency. I think the following could be helpful:

2. Fit several PMUA garbage trucks with plows. They are out early each morning and could plow snow off to the side while making their regular rounds and when DPW comes in they can finish off what has been started by the PMUA. Not in their contract? Well all things are negotiable when the economy is down and we are trying to save jobs.

3. The patrol cars can be given a couple of bags of salt for icy intersections afterhours. Since we work 24/7 there wouldn't be any overtime cost to the City. We also have two pickup trucks that we use to plow our own lot, so we could keep sand, salt, etc in the back during winter season to help out with major ice conditions at hazardous intersections after hours.

4. The Fire Department could keep salt and sand in their open pickup truck for emergency icy intersection conditions.

5. The last resort would be a call out to DPW on overtime, which would probably not be necessary if we set in motion the aforementioned plan.

I agree with this citizen that if the suggested plan (or one designed utilizing some of its components) were to be implemented, it could result in a significant dent in the City’s overtime budget for snow removal. The idea of attaching plows to the PMUA vehicles is one that has been previously mentioned; it is a shared service that can be easily implemented between the City and the PMUA.

The other suggestions can be readily implemented as a directive from the City’s Director of Public Safety. This is one way that the City’s finest and bravest can contribute to the enhancement of public safety while at the same time reducing the operating cost of the DPW. Your suggestions and feedback would be greatly appreciated as well.

The Wise Men Brought Gifts, Not a Pink Slip

It was ironic that the notice of termination from Mayor Sharon Robinson-Briggs to City Administrator Bibi Taylor was served exactly one month prior to the birthday of the late Dr. Martin Luther King, Jr., a man who spent most of his life fighting for peace and justice for all. It is also worthy to note that the termination was to take effect on the date that a new King was born, the Prince of Peace.

Thus the decision of my colleagues last night proved, in the words of Dr. King, that no lie can live forever, and that truth crushed to earth will rise again. King also said that the arc of the moral universe is long, but it bends towards justice.

I believe that justice was served last night and that the best interest of Plainfield was weighed in the balance and preserved. I applaud my colleagues, members of the public, and everyone who had a hand in turning a wrong on its head so that justice could stand erect and be dispensed for all of to see.

The unanimous vote of the council to reverse Mayor Robinson-Briggs’s ill-informed decision again evokes Dr. King's admonition that "...injustice anywhere is a threat to justice everywhere." It also reminds those who have faith and believe that the King who was born on Christmas day was the Prince of Peace, not Ebenezer Scrooge, and that the wise men brought gifts, not a pink slip.

A "Thank You" to Leaders of Unions Representing City of Plainfield Employees

Please allow me to take this opportunity to thank all of you who participated in the meeting on Friday, December 3, 2010 with Cory and me and members of the Council's Finance and Administration Committee, along with City Administrator Bibi Taylor. The meeting gave us an opportunity to interact in ways that we never have before. Our discussions were very candid, and all of us at the table appeared to have an understanding and an appreciation for the difficult roles that all of us must play in the effort to save the jobs of fellow employees. It goes without saying that the task ahead of us is a very difficult and challenging one.

I appreciate your willingness to go back to your rank and file to explore opportunities that could lead to material concessions in both the short and long term. Please know that we, as elected officials, take no joy in making the very difficult decisions that we at times are called upon to make in order to strike a balanced budget under the strictures of the budget law and other applicable statutes. It is in the spirit of current economic reality and consideration for the well-being of all employees and tax payers, as well as a desire to not lay off fellow employees that we seek to establish a partnership that leads to meaningful and compassionate concessions.

Again, I convey our thanks and appreciation to you for extending the invitation, not only to meet with you, but for the spirit in which the meeting was conducted.

Ms. Drakeford Deserves an Apology from the Editor of the Courier-News

The editorial in this past Monday’s Courier-News (11/29) left me with the feeling that the editor of the paper reached deep down into the cesspool where some newspaper editors find their material. This editorial was nothing more than a journalistic lynching of a private citizen. At best, it was disparaging and, at worst, it was slanderous to the former Corporation Counsel, Jackie Drakeford.

First of all, for the Courier to opine that “The City Council has hired an old ally of the late former mayor, Al McWilliams” and that by choosing her “guarantees that the probe will be tainted, regardless of the outcome” is just plain wrong. It suggests that all appointees of a chief executive are allies of the chief executive and are therefore incapable of being objective and impartial. If one were to swallow such twisted logic, one might arrive at the conclusion that the current Corporation Counsel, Dan Williamson, is an ally of Mayor Briggs, who appointed him, and that, therefore, any opinion he renders to the City Council pertaining to her would be tainted by his allegiance.

Furthermore, for the editor to insinuate that the probe of the $20,000 expenditure is about “New versus Old Democrats” is a conclusion that has been reached through a pair of myopic lenses. The idea for a probe into the expenditure in question came from Councilor Rashid Burney, who has disavowed any and all connections he has had to the New Democrats; he did so way back in 2005 and has been a loyal disciple of Assemblyman Green and the “Old Guard” ever since.

This probe is about actions that are questionable and the council’s desire to get to the facts so that decisions can be made in the best interest of the tax payers of Plainfield.

Finally, the editor’s conclusion that “What Plainfield needs is someone without any agenda” is an unfair presupposition about Mrs. Drakeford and her politics. Here again, the editor besmirches Mrs. Drakeford by insinuating that she has an ax to grind and would therefore use it to pin the Mayor against a wall.

This kind of journalism that attacks the reputation and credibility of a private citizen who has a stellar reputation must be seen for what it is, an "Evil Knievel" leap of monstrous proportions fraught with danger. It’s a leap that sullies the name of a decent private citizen who has stayed clear of politics for as long as I have known her. She does not deserve to be tarred with the brush of political affiliation.

Mrs. Drakeford deserves an apology from the editor of the Courier-News.

Municipalities Must Face the Harsh Realities of Today's Economy

The much-talked about 2% levy cap was on the minds of the vast majority of attendees to the 95th Annual New Jersey League of Municipalities Convention. This new levy cap will make next year the toughest in recent memory for mayors and other elected officials, who will be forced to make some very hard choices from an a la carte menu of municipal services. Municipalities will no longer be able to seek waivers from the Local Finance Board. If the tax levy is expected to be greater than 2%, the municipality would have to seek permission from the voters by way of a referendum. Municipal leaders would need to know well in advance of preparing the budget whether or not a referendum would be needed.

A very popular topic at the convention was binding interest arbitration. It is the 800 pound gorilla that keeps consuming as much as 60 to 70% of the taxes that fund municipal operations. Current statutes allow a municipality to impose a contract settlement on non-public safety unions when there is a deadlock in the collective bargaining negotiations. However, under the current system, when there is a deadlock in the collective bargaining process between a municipality and the union representing police and/or fire, the dispute must be settled in binding interest arbitration--it cannot be imposed.

Historically, judges in binding interest arbitration have awarded salary increases that average 4% without any consideration given to any of the other components, such as longevity, holiday pay, uniform allowance, college incentive or acting pay which, together with the arbitrator’s award, pushes the overall increase to about 10% annually. The general feeling is that municipalities can no longer sustain the double digit increases that public safety employees have grown accustomed to, especially with a 2% tax levy.

Greg Fehrenbach, the League's Municipal Management Advisory Service Coordinator, opined that the only solution to binding interest arbitration is to get rid of it. He felt that more people are hurt by binding interest arbitration than are helped by it, and that simply rearranging the chairs on the titanic is no solution. He suggested that dismantling binding interest arbitration is a message that must be communicated, very strongly, to members of the New Jersey state legislature.

Municipal leaders were encouraged to pursue shared services opportunities with neighboring towns and with other local governmental entities in an effort to control and or stabilize rising costs. They were also reminded of the need to file copies of past and future shared services agreements with the Director of the Division of Local Government Services. Additionally, officials were reminded of the requirement to put the last three budgets on their websites.

One of the NJLM attorneys cautioned municipalities on the imposition of across-the-board furloughs (previously believed to be permissible under the rules of the Department of Personnel). The caution was based on a recent PERC (Public Employees Relation Commission) ruling which basically precludes municipalities from unilaterally imposing furloughs, but instead requires municipalities to negotiate furloughs with collective bargaining units. The same is true for reducing an employee’s work week from full time to part time.

Some of the legislation being considered as part of the Governor’s tool kit to address the issue of out of control property taxes would result in ending terminal leave for all new hires, giving municipalities the right to opt out of the Civil Service, and changing the current system of binding interest arbitration for public safety employees.

Officials were reminded of the need to create effective strategies for controlling health benefits costs. They were encouraged to move in the direction of the private sector model where employees’ contributions are based on the cost of the benefits and not on a percentage of salary.

Essentially, municipalities have to face the harsh realities of today’s economy and must, out of shared necessity, let unions know that there is no money to afford them the kinds of increases they have come to expect. If the jobs of their members are to be protected, they must be willing to agree to costs containment concessions at the bargaining table.

Congratulations to Column A

Election Day was a bitter sweet day in Plainfield: sweet because of the success of our local democratic candidates, and bitter because of the losses that were suffered by House Democrats. The congressional losses will slow the pace of reform at the national level and will affect President Obama’s agenda in a very negative way.

Nevertheless, the American people have spoken and the President must listen. It is important for him to make the necessary adjustments to his agenda and approach, as former President Bill Clinton had to do in the wake of the 1994 mid-term elections that brought us Newt Gingrich’s “Contract with America.” President Obama, like all good leaders, must be willing to practice the art of compromise as he prepares to enter the negotiations arena with the new Speaker of the House. The challenges that the nation faces require a very strong bi-partisan effort.

The people of Plainfield can be proud of the fact that they stood with President Obama at a time when he needed them the most. They came out in large numbers to support one of his key allies, Congressman Frank Pallone. The number of registered voters in Plainfield as of October 14, 2010 stood at 21,630. Of that amount, 8,696 (40.2% of registered voters) voted in Tuesday’s election, a significant turnout in an off-year election. This was due in large measure to the tremendous efforts of New Democrats working to get the vote out in the 2nd and 3rd wards of the City, and to other Democrats who pulled the vote out in the 1st and 4th wards. I commend all of you who worked tirelessly to ensure such a significant turnout in a mid-term election.

Congressman Pallone owes his victory to the very strong show of support he got from Plainfield.

As we look to 2011 and beyond, we must do all that we can to tighten our belts in these austere times of record unemployment, a housing market that shows no sign of rebounding any time soon, dwindling state aid, declining revenues, and rising health benefits and pension costs. We must, out of shared necessity, find ways to reduce the costs of government so as to lessen the burden on homeowners who are stretched to the limits. One way to accomplish this is through an aggressive marketing effort aimed at attracting investors to our city. Another way is through shared services agreements that are based on economies of scale. We must also put pressure on our state elected officials to put an end to binding interest arbitration as we know it today.

Last, but not least, is for the state to force municipalities to consolidate and to expand the role of county government while at the same time redrawing county boundaries to align with reconfigured municipalities. These are some of the bold steps that must be taken in an effort to slow the rate of property tax increases.

Again, I wish to congratulate the entire slate of column A Democratic Party candidates for their victory on Tuesday, especially my dear friend, Councilwoman-elect Rebecca Williams, Bill Reid, and Freeholder-elect Linda Carter. I look forward to continuing to work in partnership with all of our local and county elected officials to effect change in a meaningful way.

Stay the Course with President Obama

This blog post expresses my grave concern about a threat this country faces from an army of invaders who have surrounded the nation’s capital waiting to launch an invasion after the November 2nd mid-term elections. This army can’t wait to launch its assault on the President from within the halls of congress; we must not allow that to happen.

President Obama’s agenda is under attack from members of this invading army known as the Tea Party, short for right wing Republicans. The stakes are high as the millions of corporate dollars legitimized by the nation’s Supreme Court continue to flood our airwaves with misinformation designed to cast doubt on the President’s progressive agenda. Many of the president’s allies in Congress, such as Congressman Frank Pallone and Senator Harry Reid, the shepherds and guardians of his bold reform agenda, are under severe pressure from a tidal wave of corporate dollars aimed at influencing public opinion and creating a presidential derailment. Why, we must ask ourselves? The answer is simple: It is because the president has been able to make decisions that, though unpopular to some, are in the best interest of the nation as a whole.

President Obama’s agenda is a threat to the status quo and to America’s corporate culture of greed. He has given us comprehensive healthcare reform, with all of its imperfections, something that many presidents before him promised but could not deliver. He has given us Wall Street reform and has halted the downward spiral of an economy that had been behaving as if it had been pushed off of a cliff. It is for these and other reasons that the Tea Party army of malcontents is circling the nation’s capital with its wagons.

I urge you to come out for President Obama on Tuesday as you did on that historic day in November two years ago. The change that he promised is not change that can occur overnight, but that change has already begun. It is still change that we can all believe in. We must stay the course with President Obama; it is not wise to change course mid-stream. The forward thrust, though threatened, must continue. To that end, all of the President’s allies need your support; the Democratic Party needs your support.

Therefore, I urge all of you to show your support for the President by supporting Democratic Party candidates at every level of government. I am casting my vote for Frank Pallone, Linda Carter and the other democratic freeholders, Rebecca Williams for the 2nd and 3rd Ward Council At-large seat, and all of the other candidates in column A. A vote for column A, in Plainfield, and for Democrats around the state of NJ and the nation is a vote for President Obama. If you join with me, together we can defeat the Tea Party army.
